Federal Judge Orders Freedom of Abrego Garcia from Immigration Detention
A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in federal custody.
In her decision, the court pointed out that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this allegation.
