Alina Habba resigns in the wake of appeals court deems ineligible her appointment.
The ex-lawyer for the former president has left her position as the US Attorney for New Jersey. This decision was prompted by a judicial decision that invalidated her legal standing to serve.
Official Departure
The head of the Justice Department, the Attorney General, confirmed her stepping down on the start of the week. In a statement that the court's "flawed" ruling made it unworkable for Habba to perform her duties.
"Do not interpret adherence to the ruling as defeat," she wrote. "The effort will now reach across the nation."
Judicial Challenge
Habba's exit comes a week after a judicial panel found that she had been serving in violation of the law as US attorney. This judgment is expected to impact numerous legal proceedings in the state.
The court ruled that a acting appointment that skirted confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.
Future Role and Reaction
It was also stated that she will stay on at the Department of Justice as a senior adviser. Habba plans to pursue additional appeals of the court's action, in the hope of achieving a different outcome.
On a social media platform, the Attorney General argued that the judiciary "must not countermand the President's choice of attorneys tasked with executing the primary duty of the administration of prosecuting crime."

She highlighted her tenure and pointed out that under her leadership, the city of Newark saw a one-fifth decrease in crime. Additionally that the city of Camden had its initial homicide-free summer since 1974 free from homicides.
Connection to Donald Trump
Habba, first joined Trump's personal legal team in recent years. She went on to defended her client in his business records case in New York last year, when he was guilty verdict on dozens of charges of falsifying business records.
Earlier, assuming the top New Jersey post, Donald Trump had stated he was appointing her as his White House advisor in a potential future term, describing Habba as a steadfast ally and a relentless legal advocate.
